Terms of Service for Poonya

Welcome to Poonya. By accessing or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account, signing in, or using Poonya in any way, you agree to these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Poonya is a mobile application that helps you track habits, discover and save daily quotes, set goals, and collaborate with others in groups. Features include:

  • Habit tracking and categorization
  • Daily quotes and favorites
  • Progress tracking and goal setting
  • Group creation, invitations, and chat
  • Optional in-app purchase to unlock unlimited groups

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.

3. Account Registration and Security

  • You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activities under your account.
  • You may sign in with email, Sign in with Apple, Sign in with Google, or continue as a guest. Guest accounts have limited features and data may be deleted if not converted to a full account.
  • You must be at least 13 years of age to use the App. If you are under 18, you should have a parent or guardian review these Terms.
  • We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion.

4. User Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose;
  • Harass, abuse, or harm other users;
  • Post content that is defamatory, obscene, or infringes on the rights of others;
  • Attempt to gain unauthorized access to the App, other accounts, or our systems;
  • Interfere with or disrupt the App or servers;
  • Use automated means (bots, scrapers) to access the App without our permission;
  • Circumvent any security or payment features.

We may remove content or terminate accounts that violate these rules.

4A. Content Moderation and Enforcement

To maintain a safe environment for all users, Poonya reserves the right to moderate user-generated content shared in group chats:

  • Reporting: Users may report messages they believe violate these Terms or our Community Guidelines. Reports are reviewed by Poonya staff.
  • Content Removal: We may remove any content that violates these Terms, our Community Guidelines, or applicable law. When content is removed, a system notice will be posted in the affected group chat.
  • Account Suspension: Users who violate these Terms may have their accounts temporarily or permanently suspended. Suspended users will be notified upon their next login attempt and may contact us for further information.
  • Appeals: If you believe your content was removed or your account was suspended in error, you may contact us at the email address provided in Section 14 below.

5. User Content

  • You retain ownership of content you create (habits, quotes, messages). By posting content, you grant us a non-exclusive, royalty-free license to use, store, and display that content to provide and improve the service.
  • You are responsible for your content. We do not endorse and are not responsible for user-generated content.
  • Group content (e.g., chat messages) may be visible to other members of that group. Do not share sensitive information in groups.

6. In-App Purchases

  • Poonya offers an optional in-app purchase to unlock unlimited groups. Payment is processed through the Apple App Store.
  • All purchases are final unless otherwise required by law or Apple's refund policy. Refund requests must be made through Apple.
  • Your purchase may be associated with your account for cross-device access, subject to our verification of the transaction.

7. Intellectual Property

  • Poonya, its logo, and the App are owned by us. You may not copy, modify, distribute, or create derivative works without our written permission.
  • Third-party trademarks (e.g., Apple, Google) are the property of their respective owners.

8. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our collection and use of information as described in the Privacy Policy.

9. Disclaimers

  • THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
  • WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF THE APP.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
  • SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify and hold harmless Poonya and its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your content, or your violation of these Terms.

11. Termination

  • You may stop using the App at any time. You may delete your account and data through the App or by contacting us.
  • We may terminate or suspend your access at any time, with or without cause or notice.
  • Upon termination, your right to use the App ceases. Provisions that by their nature should survive (e.g., disclaimers, indemnification, limitations of liability) will survive.

12. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App.

13. Governing Law and Disputes

These Terms are governed by the laws of [Your jurisdiction, e.g., the State of California, USA], without regard to conflict of law principles.
